Stout Buckets 12 Month-Limited Warranty

Smith Equipment Consolidated Inc., DBA Stout Buckets (“we”) located at address N6680 County Road Q, P.O. Box 38, Knapp, WI 54749 extend this limited warranty for skid steer attachments manufactured by us with clear “Stout Authorized Dealer” markings and numbering (the “product”) to be free from defects in materials and workmanship for a period of Twelve months from the date of purchase to the consumer who originally purchased the product (“you”) as described below in this warranty statement.

THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER RIGHTS, WHICH VARY FROM STATE TO STATE.

THE LIMITED WARRANTY CAN ALSO BE FOUND ONLINE AT www.stoutbuckets.com/pages/warranty-information AND IN THE DOCUMENTATION WE PROVIDE WITH THE PRODUCT.

WE WARRANT THAT DURING THE WARRANTY PERIOD, THE PRODUCT WILL BE FREE FROM DEFECTS IN MATERIALS AND WORKMANSHIP.

WE LIMIT THE DURATION AND REMEDIES OF ALL IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE TO THE DURATION OF THIS EXPRESS LIMITED WARRANTY.  SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

OUR RESPONSIBILITY FOR DEFECTIVE GOODS IS LIMITED TO REPAIR OR REPLACEMENT AS DESCRIBED BELOW IN THIS WARRANTY STATEMENT.

Who is covered by this warranty?

  • We extend this limited warranty only to the consumer who originally purchased the product, the original purchaser. It does not extend to any subsequent owner or other transferee of the product.

What does this warranty cover?

  • This limited warranty covers defects in materials and workmanship of the skid steer attachments manufactured by us with clear “Stout Authorized Dealer” markings and numbering, the product, for the Warranty Period as defined below.

What is the period of warranty coverage?

  • This limited warranty starts on the date of your purchase from a Qualified Seller as defined below and lasts for twelve (12) months (the “Warranty Period”). The Warranty Period is not extended if we repair or replace the product.  We may change the availability of this limited warranty at our discretion, but any changes will not be retroactive.

Who is a Qualified Seller?

  • A “Qualified Seller” is a Stout Buckets Authorized Dealer in good standing, as determined in our sole discretion.

What does this warranty not cover?

  • This limited warranty does not cover any damage due to transportation or storage.
  • This limited warranty does not cover damage due to improper use, failure to follow the product instructions or to perform any preventive maintenance, unauthorized repair, or external causes such as accidents, abuse, or other actions or events beyond our reasonable control.
  • This limited warranty does not cover products which have been operated in excess or negligence.
  • This limited warranty does not cover normal wear and tear or normal wear items, including but not limited to, bearings, hoses, chains, and any ground engaging parts such as teeth, blades, or cutting edges.
  • This limited warranty does not cover maintenance, service, or adjustments.
  • This limited warranty does not cover damage due to improper application, installation, adjustment, or setup.
  • This limited warranty is void if any components of the product have been modified or disassembled, including but not limited to, hydraulic cylinders or hydraulic motors.
  • This limited warranty does not cover specially- or custom-modified attachments built by Smith Equipment Consolidated Inc., DBA Stout Buckets to meet requested customer needs.
  • This limited warranty does not cover replacement parts not supplied by Smith Equipment Consolidated Inc., DBA Stout Buckets, including but not limited to, pallet fork tines.
  • This limited warranty does not cover product purchased through auction, whether the product is used, un-used, or new.

How do you obtain warranty service?

  • To obtain warranty service, you must notify us by calling (715)-665-2000 or by emailing our Customer Service Department at Warranty@StoutBuckets.com during the Warranty Period. You may also notify the Qualified Seller where the product was purchased during the Warranty Period.
  • You must provide proof of purchase to us and provide any documentation we determine is needed to make a warranty determination, including but not limited to, photos of the product and any damage to the product.
  • You must return the defective product postage prepaid to us if we determine the defective product needs to be returned.
  • We have no obligation to respond to any warranty claims that are outside of the Warranty Period.

What are your remedies under this warranty?

  • With respect to any defective product during the Warranty Period, we will, in our sole discretion, either repair or replace such product (or the defective part) free of charge. You will be responsible for shipping and handling fees for the repaired or replacement product.

LIMITATION OF LIABILITY

  • THE REMEDIES DESCRIBED ABOVE ARE YOUR SOLE AND EXCLUSIVE REMEDIES, AND OUR ENTIRE LIABILITY FOR ANY BREACH OF THIS LIMITED WARRANTY. OUR LIABILITY SHALL UNDER NO CIRCUMSTANCES EXCEED THE ACTUAL AMOUNT PAID BY YOU FOR THE DEFECTIVE PRODUCT, NOR SHALL WE UNDER ANY CIRCUMSTANCES BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES OR LOSSES, WHETHER DIRECT OR INDIRECT, INCLUDING BUT NOT LIMITED TO, LOST PROFITS, DELAYS, LOST TIME, OR RENTAL OR SUBSTITUTE EQUIPMENT COSTS.
  • SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

What can you do in case of a dispute with us?

  • We will attempt to settle any product warranty claims with you in a timely and reasonable manner, however, if you believe that we have not performed our obligations under this limited warranty, you may pursue any legal suit, action, or proceeding arising out of or relating to this limited warranty, and you (a) submit to the non-exclusive jurisdiction of the courts located in Dunn County, Wisconsin and the United States District Court for the Western District of Wisconsin for resolution of any dispute concerning this Limited Warranty; (b) waive any objection to venue of any suit, action, or proceeding in such courts; and (c) waive any objection and agree not to plead or claim in any such court that any such suit, action, or proceeding brought in any such court has been brought in an inconvenient forum.
